The Indigenous Cultural Heritage under Commonwealth Law – Tangible and Intangible Master Class provides an in-depth examination of the circumstances in which Indigenous Cultural Heritage is relevant to decisions under key federal legislation and its application in Western Australia.

Recent Federal Court cases have highlighted the significance of Indigenous Cultural Heritage to decision making under several key pieces of Commonwealth legislation. These include the Environment Protection and Biodiversity Conservation Act 1999, the Offshore Gas and the Offshore Electricity Infrastructure legislative regimes, and the Aboriginal and Torres Strait Islander Heritage Protection Act 1984.

“Cultural heritage is physical but, in this physicality, the intangible manifests. It’s our responsibility to understand both these forms and incorporate them within our work.”

This four hour Master Class will explore the circumstances that Indigenous Cultural Heritage is relevant to decisions under this legislation, the definitions of both tangible and intangible Indigenous Cultural Heritage that are used in the legislation and compares these definitions to relevant Western Australian law. The Master Class will also discuss current departmental operational policy with regard to application of this Commonwealth law and potential future development of these regimes.

Designed for those working in the area, including heritage advisors, professionals working in planning, resources, environmental regulation or community policy areas, lawyers (QA approved by the LPBWA for 4 CPD points) and those interested in Native Title & Cultural Heritage more generally; this Master Class provides an in-depth understanding of both tangible and intangible Indigenous Cultural Heritage under Commonwealth Law.

This half day seminar (9:00am - 1:00pm) will be held on Friday 7 March 2025 in Boorloo (Perth) at QT Perth (133 Murray St, Perth WA 6000). It includes resource materials & morning tea.
